CONTEST RULES : Slip On Your Helmet

Definition

  • The “Slip On Your Helmet” contest (hereinafter referred to as “the Contest”) is organized by CRÉATION STRATÉGIQUE ABSOLUE INC. and Groupe Tecnic 2000 inc. (hereinafter referred to as “the Organizers”). The Contest will be held on the internet from Monday, January 13, 2020, to Friday, March 27, 2020 until 23:59.

ENTRY REQUIREMENTS

  • Participants must reside in Canada and have reached the age of majority (18 years) at the time of their participation in the contest.
  • Individuals who have not disclosed their full names and addresses or provided them in an inaccurate or misleading way will be disqualified, as well as those who refuse the collection, registration and use of personal information concerning them. This is strictly necessary for the administrative requirements of the Contest.
  • The use of an exchange group or automatic script to win automatically leads to the elimination of the participant without notice.
  • The participation in the Contest implies for all participants full, unreserved acceptance of these rules.
  • Failure to comply with this regulation will automatically cancel the participation and attribution of rewards.
  • Excluded: employees, agents and representatives of the Organizers, their affiliated companies and agencies, their advertising and promotional agencies, materials and service suppliers related to this Contest or any other parties directly involved in the Contest, and members of their immediate family. For the purposes hereof, "immediate family" means a father, mother, brother, sister, child, spouse or common-law partner and all persons with whom said employees, representatives and agents reside.
  • Winners must sign the prize declaration letter on the spot when reclaiming the prize.

PARTICIPATION MODE

  • Only one entry (natural person) is counted for the total duration of the Contest.
  • An entry equals a chance of winning the Grand Prize.
  • A random draw will be made among all participants who have complied with these rules.
  • No purchase required.

PRIZE DESCRIPTION

  • The winner obtains 1 motorcycle driving course valued at approximately $ 1000.00. The prize includes 6 hours of theoretical courses and 26 hours of practical motorcycle driving lessons (16 hours closed track and 10 hours on the road network). Please note that the course material is not included.

Personal information

  • It is recalled that to enter the Contest, participants must provide certain personal information (full name, email, telephone, etc.). This information is recorded and saved in a computer file and is required to account for their participation in the determination of the winner and the attribution and delivery of the prize. This information is intended for the Organizers and may be transmitted to their technical service providers and to a service provider that sends the prize.
  • By entering the Contest, the data collected from the participant may be used within a legal framework.

AWARDING OF PRICE

  • A draw will be held on Monday, March 30th, 2020, among all participants who have complied with the rules.
  • The, randomly drawn participants, will be declared the winner, subject to fulfilling all the conditions described in these rules as well as course requirements.
  • The winner will be contacted by email within five (5) days of the draw date. The winner must confirm acceptance of his/her prize, by email or by telephone, within seven (7) days from the date the email was sent. Subsequently, the winner will have a maximum delay of forty-five (45) days to claim the prize from the Tecnic Driving School of his/her choice. If the prize is not claimed within this period or if the participant cannot be contacted within fourteen (14) days from the date when he or she was contacted the first time, a new random draw will be made.
  • The prize will be awarded to the winner by the Organizers and the winner must sign the letter of representation in order to redeem his/her prize.
  • ID will be required to claim the prize.
  • The winner must comply with the Contest rules as well as course obligations. If it turns out that he/she does not meet the criteria of these rules, he or she will not be awarded their prize. The participants authorize all verification concerning their identity, age, postal address as well as the loyalty and sincerity of their participation. As such, the Organizers reserve the right to request a copy of the winner's ID before sending the prize. Any false declaration or indication of false identity or address entails the immediate elimination of the participant and, if applicable, reimbursement of the prize if already sent.

GENERAL RULES

  • By simply accepting his/her prize, the winner authorizes the Organizers to use his or her name and city of residence in any promotional event, on the Organizer’s website and on any other affiliated sites or support, and without such use conferring them any rights and remuneration other than the awarded prize.
  • The prize must be accepted as such; it may not be substituted for another Prize or exchanged, in whole or in part, for its cash value, subject to the provisions of the next paragraph. However, the winner may transfer the prize to the person of his/her choice if he/she so desires or has already followed and completed their motorcycle driving course. In the event that the winner has already bought his or her Tecnic motorcycle course and has not yet followed or completed it, the Organizers agree to a full refund of the course as a prize.
  • In the event that it is impossible to provide the prize as described in these rules, the Organizers reserve the right to substitute all or part of the prize for one or more prizes of approximately equivalent value.
  • The refusal to accept the prize releases the Organizers from any liability and any obligation towards the winner.
  • Any false declaration by a participant automatically results in his disqualification from the Contest.
  • The Organizers assume no liability for losses, delays, address errors in the mail or email received, printing errors, technical, computer or telephone malfunctions, software or computer equipment breakdowns, fraudulent calls or any other error.
  • The Organizers assume no liability of any nature in all cases where their inability to act would result from an unforeseeable fact or situation beyond their control including strikes, lockouts or any other labor disputes in their establishment or in the establishments of the organizations or businesses whose services are used for this Contest.
  • All personal information such as an entrant’s name, full-mailing address, phone number, email address and age, are collected solely for the purposes of administering this Contest and will not be used for any other purpose without consent. By providing such information, participants consent to their use for the purposes stated.
  • Participation in the Contest entails the acceptance of these rules. CRÉATION STRATÉGIQUE ABSOLUE INC. is responsible for their application and all decisions are final and without appeal.
  • Limitation of liability – use of prize. Any person selected releases the Contest Organizers, their respective affiliated companies and divisions and any other body corporate from their respective corporate group, their advertising and promotional agencies, their shareholders, directors, officers, employees, agents and representatives (hereinafter referred to as “The Beneficiaries”) from any liability for any damages incurred as a result of the acceptance or use of his or her prize. In order to be declared a winner and prior to obtaining the prize, the selected entrant agrees to sign the Declaration and Release Form for this purpose.
  • Limitation of liability – participation. By participating or attempting to participate in this Contest, all persons release the beneficiaries from any liability for any damage they may have incurred as a result of their participation or attempted participation in the Contest.
  • Unenforceable paragraph. If any section of these contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered void, but all other sections not affected will be applied within the limits authorized by law.
  • Litigation. A dispute regarding the organization or conduct of a publicity Contest may be submitted to the Régie des Alcools for a ruling. A dispute concerning the awarding of a prize may be submitted to the Régie only for the purpose of an intervention in an attempt to resolve it.

Limitation of LIABILITY

  • Participation in the competition implies the knowledge and acceptance of the characteristics and limits of the internet, particularly with regard to technical performance, response times for consulting, querying or transferring information, risks of interruption and, more generally, the risks inherent in any connection and transmission on the internet, the absence of protection of certain data against any misappropriation and the risks of contamination by possible viruses circulating on the network. As a result, the organizers cannot under any circumstances be held responsible, without this list being limited to:
  • Dysfunctions of the internet network that prevents the proper functioning of the Contest ;
  • Failure of receiving equipment or communication lines; the loss of any paper mail or email and, more generally, the loss of any data;
  • Delivery problems;
  • Functioning of any software;
  • Consequences of any virus, computer bug, anomaly or technical defect
  • Any damage caused to a participant's computer;
  • Any technical, hardware or software defect of any nature whatsoever preventing or limiting participation in the Contest or having damaged the system of a participant;
  • Dysfunction of the prize awarded in connection with the Contest, and any direct or indirect damages (or both) that it may cause;
  • Transmission or receptions (or both) of any data or information (or both) on the internet.
  • It is specified that the Organizers cannot be held liable for any direct or indirect damage resulting from any interruption or malfunction of any kind, resulting from a connection to the site developed with the framework of this Contest. It is the responsibility of all participants to take all appropriate measures to protect their own data or software (or both) stored on their computer equipment from harm.
  • The connection of all persons to the Contest page and the participation of the participants in the Contest is their sole responsibility. The Organizers may cancel all or part of the Contest if it appears that fraud has taken place in any form whatsoever, in particular in a computerized manner or in determining the winners. In such cases, they reserve the right not to allocate funds to fraudsters or to sue the perpetrators of these frauds (or both) before the competent courts. ). They cannot, however, incur any liability of any kind vis-à-vis participants as a result of any fraud committed,

If as a result of an event beyond their control, they were compelled to apply this right, their liability could not be incurred.
  • The Organizers reserve the right to permanently exclude any person who, through his fraudulent behavior, would interfere with the smooth running of the Contest. In addition, the sponsorship of fictitious persons will result in the immediate elimination of the participant. Similarly, any attempt to use the Contest outside the unmodified interface set up on the site will be considered an attempt at fraud.
